These Terms of Use ("Terms") are a legal agreement between you and Dustark ("we," "us") governing your use of the LensSearch iOS app ("the app"). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.
LensSearch identifies a physical object from a photo and shows currently active eBay listings for similar items, to help you gauge what an item is and what it is selling for. The app is an independent utility and is not affiliated with, endorsed by, or sponsored by eBay, Google, Apple, or any listing seller. "eBay," "Google Lens," and other marks belong to their respective owners.
Prices shown are drawn from active (for-sale) listings, not completed or "sold" prices, and are provided for general information only. They are estimates, may be inaccurate, incomplete, or out of date, and are not an appraisal, a guarantee of value, or financial, investment, or purchasing advice. The "Lowest" and "Typical" prices are calculated automatically from the listings found, and may leave out or discount listings that appear to be broken or for parts, or that are priced unusually high or low. Item identifications are automated and may be wrong. You are solely responsible for any buying, selling, or other decisions you make. Always verify details on eBay before transacting.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, in accordance with Apple's App Store Terms of Service and these Terms. You may not: reverse-engineer, decompile, or modify the app except as permitted by law; resell, rent, or sublicense it; use it to violate any law or any third party's rights; or attempt to disrupt, abuse, or circumvent the app's servers, rate limits, usage limits, or security (including its device attestation).
The app does not require an account or sign-in. Your scans, history, and purchase balances are stored on your device (see the Privacy Policy).
Access to scanning is metered:
A scan is counted only when it completes. A scan that ends in an error is not counted, and showing results the app has already cached for the same item is free. You can buy credits, subscribe, or restore a subscription from the Credits & Pro section of Settings.
To prevent abuse and control costs, our servers also apply technical limits on the number of searches per install and overall. These limits sit above the allowances described here, but if one is reached, searches may be temporarily unavailable.
By subscribing you agree to these terms, the Privacy Policy, and Apple's applicable terms. Purchases are also subject to the App Store's refund and billing policies; refund requests are handled by Apple.
The app, its design, and its original content are owned by us and protected by law. Listing data, images, and trademarks shown in results belong to eBay, the sellers, or their respective owners and are displayed for informational purposes.
Search results, listing details, images, and outbound links to eBay listings are third-party content we do not control and do not guarantee. Following an outbound link takes you to a third-party website governed by that party's terms and privacy policy.
The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that identifications or prices are accurate, that the app will be uninterrupted or error-free, or that results will meet your expectations.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost savings, or losses arising from buying or selling decisions, even if advised of the possibility. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the 12 months before the claim or USD $50.00. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
These Terms apply until terminated. We may suspend or terminate your access if you breach them. You may stop using the app at any time by uninstalling it. Sections that by their nature should survive termination (e.g., disclaimers, limitation of liability, intellectual property) will survive.
We may modify the app, its features, pricing, or these Terms. Material changes to these Terms will be reflected by updating the "Last updated" date. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws rules, except where your local consumer-protection law provides otherwise.
